We Scale Creators LLC acts as a marketing and operational partner supporting certain aspects of the Company's programs and services. References to "Company" within limitation of liability, indemnification, and other protective provisions include We Scale Creators LLC and its respective owners, officers, directors, employees, contractors, agents, affiliates, successors, and assigns.

These Terms govern your access to and use of any digital products, educational programs, content, resources, community environments, and online platforms offered by the Company, including but not limited to:

 - The No Bad Dogs System

 - The Reactivity Masterclass

 - The No Bad Dogs Kickstarter Course

 - Master the Walk

 - Reactive to Neutral Dog

 - E-Collar Introduction

 - The No Bad Dogs Inner Circle, including all live coaching calls, video reviews, custom game plans, monthly expert sessions, member-only courses, training vault materials, call recordings, and private community access

 - Any associated bundles, including The Leash Master, The Freedom Pack, The Advanced Pack, and The Complete System

 - Any associated bonuses, downloadable materials, or resources

 - Access to the No Bad Dogs member area or digital platforms (collectively, the "Programs" or "Services").

By purchasing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you may not access or use the Services.

The Services are provided to customers located within the United States and internationally where permitted by applicable law.

The Programs and Services provided by the Company are educational and informational in nature.

The content provided within the Programs may include information related to:

 - dog training strategies and methodologies

 - obedience training techniques

 - leash handling and walk structure

 - behavior modification and reactivity management

 - e-collar introduction and off-leash communication

 - crate training, impulse control, and foundational commands

 - canine behavior, body language, and communication principles

 - general relationship-building between owners and dogs

However, the Programs do not constitute veterinary advice, behavioral therapy provided by a licensed veterinary behaviorist, or any form of professional veterinary or medical guidance and are not intended to replace consultation with a licensed veterinary professional where appropriate.

Participation in the Programs does not replace professional veterinary evaluation or behavioral assessment by a certified veterinary behaviorist where a dog's behavior presents a safety concern.

Users should consult their own veterinarian or qualified professional regarding any health, safety, or behavioral concerns specific to their dog.

The No Bad Dogs Inner Circle includes live group coaching calls, review of participant-submitted video, and written or verbal feedback from Tom Davis and the Company's team. This coaching, feedback, and any custom game plan provided to a participant is educational and informational in nature. It is not veterinary advice, behavioral therapy, or an individualized behavioral assessment, and it does not replace an in-person evaluation by a licensed veterinarian or certified veterinary behaviorist.

Accessing or purchasing the Programs does not establish a professional advisory relationship, veterinary-client-patient relationship, or any fiduciary relationship between you and:

 - any affiliated coach, trainer, mentor, or team member

The Programs are strictly educational products. Neither No Bad Dogs LLC nor We Scale Creators LLC is a licensed veterinarian, certified veterinary behaviorist, or licensed animal behavioral consultant. The Programs provide general educational content based on the training methodology and professional experience of Tom Davis and the Upstate Canine Academy team.

Participation in the No Bad Dogs Inner Circle, including receiving live coaching, video feedback, or a custom game plan, does not create any of the relationships described in this section. Coaching feedback is general educational guidance based solely on the limited video footage and information a participant chooses to submit. It is not based on an in-person examination of any dog and does not account for information the Company does not have, including a dog's medical history, neurological condition, or behavior outside the submitted footage. Participants remain solely responsible for deciding whether to apply any feedback to their own dog.

Individual results from the Programs will vary.

The Company makes no guarantees regarding specific training outcomes, behavioral changes, or timelines for improvement.

Any testimonials, case studies, or examples referenced in marketing materials or within the Programs are provided for illustrative purposes only and do not represent typical or guaranteed results.

Participants acknowledge that results depend on many factors beyond the Company's control, including but not limited to:

 - individual implementation of techniques and consistency of practice

 - the dog's breed, age, temperament, health, and behavioral history

 - the owner's prior training experience and skill level

 - the home environment, household dynamics, and daily routine

 - adherence to recommended strategies, timing, and progression

 - the presence and severity of pre-existing behavioral conditions

 - the owner's physical ability to safely handle and manage the dog

Dog training involves inherent risks, including but not limited to the risk of bites, scratches, physical injury to the handler or to bystanders, property damage, and unpredictable canine behavior.

By purchasing, accessing, or using the Programs, you acknowledge and accept the following:

 - You assume full responsibility for your own safety and the safety of others when implementing any techniques, commands, or strategies taught within the Programs.

 - You assume full responsibility for the welfare and safety of your dog when applying any training methods demonstrated in the Programs.

 - You are solely responsible for evaluating whether any technique is appropriate for your dog's breed, age, temperament, size, health status, and behavioral history.

 - You are solely responsible for determining whether you can safely and physically handle your dog during training exercises.

 - You acknowledge that working with reactive, fearful, or aggressive dogs carries elevated risk of injury and that the Programs are educational resources, not substitutes for hands-on professional behavioral assessment.

 - You acknowledge that e-collar training, leash pressure techniques, and behavior modification work involve tools and methods that require proper timing, technique, and judgment, and that improper application may cause unintended outcomes.

The Company, We Scale Creators LLC, Tom Davis, and their respective owners, officers, directors, employees, contractors, affiliates, agents, successors, and assigns are not responsible for any injuries, damages, losses, or adverse outcomes resulting from any participant's implementation of techniques taught within the Programs.

If your dog has a history of biting, aggression toward humans or other animals, or any behavior that presents a safety concern, you are strongly encouraged to seek an in-person evaluation from a qualified professional trainer or certified veterinary behaviorist before applying techniques from the Programs.

Certain Programs may reference or recommend training equipment, including but not limited to leashes, collars, e-collars, long lines, crates, and related tools.

The Company does not control and is not responsible for:

 - the selection, fit, or use of any training equipment by the participant

 - the quality, safety, or performance of any third-party equipment or products

 - any injury or damage resulting from improper equipment selection, fit, or use

 - the terms, conditions, warranties, or return policies of any third-party equipment provider

Participants are solely responsible for ensuring that all equipment used during training is properly fitted, in good working condition, and appropriate for their dog's size, breed, and temperament.

Any product recommendations, discount codes, or brand references within the Programs are provided for informational purposes only and do not constitute endorsements or warranties of third-party products.

Upon purchase of a Program, participants may receive access to the No Bad Dogs member area, a digital platform used to deliver course materials, resources, and educational content.

Access to the platform may include:

 - video modules and training demonstrations

 - downloadable resources and supplemental materials

 - program materials and course guides

 - bonus content

 - community features where available

Platform access is granted as a limited, revocable, non-transferable license for personal use only.

The Company reserves the right to modify or discontinue platform access at any time.

The No Bad Dogs Inner Circle is delivered in cohorts. Enrollment opens and closes on dates determined by the Company, and cohort size is limited at the Company's discretion.

By enrolling, you acknowledge and agree that:

the live coaching portion of the Inner Circle runs for six weeks, beginning on the cohort start date published at the time of enrollment

coaching calls are scheduled by the Company, and the Company may change call dates, times, or format

attendance at live calls is not required but is not rescheduled or made up for individual participants

all coaching calls are recorded, and recordings are made available to cohort participants

your enrollment is personal to you and may not be transferred, assigned, resold, or deferred to another cohort or another individual

failure to attend calls, submit video, or otherwise participate does not extend the coaching period, entitle you to additional access, or entitle you to any refund or credit

Access to course library materials, member-only courses, vault content, and call recordings is provided as a limited, revocable, non-transferable license for personal use only. The Company may modify, relocate, or discontinue any platform, course, or content at any time. The Company reserves the right to remove any participant from the Inner Circle, its calls, and its community for conduct described in the Community Conduct section of these Terms, without refund.

Participants may submit video, photographs, audio, written descriptions, or other content to the Company for review ("Participant Content").

By submitting Participant Content, you represent and warrant that:

- you own or otherwise control all rights to the Participant Content you submit

- you have obtained the consent of every identifiable person appearing or heard in the Participant Content, and of the owner of any other animal or property appearing in it

- the Participant Content does not infringe the rights of any third party

- any person appearing in Participant Content is at least eighteen (18) years of age, or appears with the consent of a parent or legal guardian

By submitting Participant Content, you grant the Company a worldwide, royalty-free, non-exclusive, perpetual, irrevocable license to use, reproduce, display, and adapt the Participant Content for the purpose of reviewing it, providing feedback, and delivering the Inner Circle, including by playing it back and discussing it on live coaching calls that are recorded and distributed to cohort participants.

You acknowledge that Participant Content you submit may be viewed by Tom Davis, Company personnel, and other cohort participants, and that it may appear in call recordings that remain available to cohort participants after the coaching period ends. You should not submit any content you are not comfortable sharing in that environment.

Use of Participant Content in advertising, marketing, or public promotional materials is not covered by this section and will be requested separately in writing.

Participants may be granted access to a private online community associated with the Programs, including the private community and live coaching call environment associated with the No Bad Dogs Inner Circle.

Participants agree to conduct themselves respectfully and professionally within any community environment.

Prohibited conduct includes, but is not limited to:

 - harassment or abusive behavior toward other members or Company representatives

 - providing dangerous or unqualified behavioral advice to other members

 - spreading misinformation about training methods, tools, or animal behavior

 - solicitation of participants for competing products or services

 - sharing or distributing proprietary materials outside the community

The Company reserves the right to remove participants from community environments or terminate program access for violations of community standards.

All content provided through the Programs is the intellectual property of the Company.

This includes, but is not limited to:

 - The No Bad Dogs System curriculum and methodology

 - The Reactivity Masterclass content

 - Master the Walk, Reactive to Neutral Dog, and E-Collar Introduction course content

 - All program videos, documents, demonstrations, and training materials

 - Training frameworks, strategies, and educational methodologies

 - Community content and proprietary resources

- The No Bad Dogs Inner Circle curriculum, coaching materials, and member-only course content, including the Seminar Series and Real-World Mastery courses

- all live coaching call recordings and the No Bad Dogs training vault library

- custom game plans, written feedback, and coaching notes provided to participants

Participants are granted a limited license for personal use only.

Participants may not:

 - reproduce program materials

 - distribute program materials

 - share login access

 - resell or sublicense program content

 - create derivative works based on the Programs

 - use the Programs for commercial training, teaching, or resale purposes

Unauthorized use may result in termination of access and legal enforcement.

Program pricing is displayed at the time of purchase.

The No Bad Dogs System is offered at a one-time payment of $27. The Reactivity Masterclass bundle, which includes the Reactivity Masterclass and the complete No Bad Dogs Kickstarter Course, is offered at a one-time payment of $197. The Master the Walk and E-Collar Introduction bundle is offered at a one-time payment of $147. Individual course pricing and bundle pricing for Master the Walk, Reactive to Neutral Dog, E-Collar Introduction, The Leash Master, The Freedom Pack, The Advanced Pack, and The Complete System are displayed at the time of purchase and may be updated from time to time at the Company's discretion.

The No Bad Dogs Inner Circle is offered at a one-time payment of $997, or at the participant's election, three (3) monthly installments of $350 each.

If you select the installment option, you authorize the Company to automatically charge your selected payment method $350 at the time of enrollment and $350 on each of the two (2) subsequent monthly billing dates, without further notice. You are responsible for the full installment plan balance once you enroll. The installment option is a payment schedule, not a subscription, and it cannot be cancelled to avoid the remaining balance.

If an installment payment fails or is declined, the Company may suspend or terminate your access to the Inner Circle and all associated materials until the balance is brought current, and may pursue recovery of the outstanding balance and any associated costs where permitted by law. Payments already made are not refunded upon suspension or termination for non-payment.

All payments are processed through third-party payment processors.

By completing a purchase, you authorize the Company to charge your selected payment method for the applicable purchase amount.

All sales are final. The Company does not offer refunds on any product, program, or purchase, including The No Bad Dogs System and the No Bad Dogs Inner Circle. There is no money-back guarantee on any purchase.

Any guarantee, promise, or commitment described in the Company's marketing materials relating to the No Bad Dogs Inner Circle is a commitment of continued instruction and support subject to the conditions stated in the Company's Refund Policy. It is not a money-back guarantee and does not entitle any participant to a refund, credit, or partial refund under any circumstances.

Access to Program materials may be revoked upon any termination of access.

The Company's full Refund Policy is incorporated into these Terms by reference.

By purchasing the Programs, you agree not to initiate a chargeback without first contacting the Company to resolve the issue.

In the event of a chargeback:

 - access to the Programs may be terminated

 - evidence of agreement to these Terms may be submitted in dispute proceedings

 - the Company may pursue recovery of associated costs where permitted by law

To the fullest extent permitted by applicable law, the Company and We Scale Creators LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to the use of the Programs.

This includes, without limitation:

 - injuries to persons or animals resulting from implementation of training techniques

 - property damage resulting from canine behavior during or after training

 - adverse behavioral outcomes in dogs

 - training outcomes or behavioral results

 - reliance on educational materials

 - equipment-related injuries or damages

 - decisions made based on Program content

 - use of any third-party platform, product, or equipment

- reliance on live coaching, video feedback, a custom game plan, or any guidance provided by Tom Davis or the Company's team

- conduct of, or content posted by, other participants in any community or coaching environment

The Company's total liability for any claim related to the Programs shall not exceed the total amount paid by the participant for the applicable Program.

By purchasing, accessing, or using the Programs, you agree to indemnify, defend, and hold harmless No Bad Dogs LLC, We Scale Creators LLC, Tom Davis, and their respective owners, officers, directors, employees, contractors, affiliates, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

 - your use of the Programs or reliance on Program materials

 - your implementation of training techniques, commands, or methods taught in the Programs

 - injuries to yourself, other persons, other animals, or property arising from your training activities

 - your dog's behavior during or after implementation of any Program content

 - your violation of these Terms or any applicable law or regulation

 - any dispute between you and any third-party product or equipment provider

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable arbitration rules.

Arbitration shall be conducted on an individual basis.

Class actions, collective actions, or representative proceedings are not permitted.

The arbitration decision shall be final and enforceable in any court of competent jurisdiction.

The Company reserves the right to modify these Terms at any time.

Updated Terms will become effective upon posting within the member area or on the Company's website.

Continued use of the Services after modifications constitutes acceptance of the revised Terms.

By providing your mobile phone number and opting in, you consent to receive recurring text messages from No Bad Dogs LLC related to your account, program updates, trade alerts, coaching, and promotional offers. Consent to receive these messages is not a condition of any purchase.

Message Frequency: Message frequency varies.

Costs: Message and data rates may apply. These charges are billed by and payable to your mobile service provider. No Bad Dogs LLC. is not responsible for any carrier charges.

Opt-Out: You can cancel the SMS service at any time by replying STOP to any message. After you send STOP, we will send a one-time confirmation that you have been unsubscribed, and you will receive no further messages. To rejoin, sign up again as you did initially.
